7.A.    Council approved draft minutes of a Worksession, a Special Meeting and a Regular Meeting held on October 27, 2008; and draft minutes of a Worksession and a Special Meeting held on November 3, 2008.

7.B.    (08-3990) Council approved a request from Nathan Torres, representing the City of Goodyear, for a Series 5 Liquor License, #05073027, for the City of Goodyear Ballpark, located at 1933 S. Ballpark Way, Goodyear, AZ.

7.C.    (08-4017) Council approved the request for a use permit to allow a convenience use (CVS Pharmacy with drive-through) on a 1.62-acre parcel generally located at the southwest corner of Yuma Road and Cotton Lane in the Cottonflower Marketplace Commercial Center, subject to stipulations.

7.D.    (08-4001) Council approved a Special Use application to allow a preschool facility in the Agricultural/Urban (AU) zoning district generally located on the east side of Sarival Avenue approximately ¼ mile north of Van Buren Street, subject to stipulations.

7.E.    (08-3983) Council adopted Ordinance 08-1145 extending and increasing the corporate limits of the City of Goodyear, Maricopa County, State of Arizona, pursuant to the provisions of Title 9, Chapter 4, Article 7, Arizona Revised Statutes and amendments thereto, by annexing the Cotton Lane Right-of-Way from McDowell Road to Indian School Road which is contiguous to the existing City limits of the City of Goodyear.

7.F.    (08-3984) Council adopted Ordinance 08-1146 extending and increasing the corporate limits of the City of Goodyear, Maricopa County, State of Arizona, pursuant to the provisions of Title 9, Chapter 4, Article 7, Arizona Revised Statutes and amendments thereto, by annexing the Camelback Road Right-of-Way from Cotton Lane to Village Parkway which is contiguous to the existing City limits of the City of Goodyear.

7.G.    (08-3985) Council adopted Ordinance 08-1147 extending and increasing the corporate limits of the City of Goodyear, Maricopa County, State of Arizona, pursuant to the provisions of Title 9, Chapter 4, Article 7, Arizona Revised Statutes and amendments thereto, by annexing the Indian School Road Right-of-Way from Cotton Lane to Loop 303 which is contiguous to the existing City limits of the City of Goodyear.

7.H.    (08-3986) Council adopted Ordinance 08-1148 extending and increasing the corporate limits of the City of Goodyear, Maricopa County, State of Arizona, pursuant to the provisions of Title 9, Chapter 4, Article 7, Arizona Revised Statutes and amendments thereto, by annexing the Cotton Lane Right-of-Way from Indian School Road to Camelback Road which is contiguous to the existing City limits of the City of Goodyear.

7.I      (08-3987) Council adopted Ordinance 08-1149 extending and increasing the corporate limits of the City of Goodyear, Maricopa County, State of Arizona, pursuant to the provisions of Title 9, Chapter 4, Article 7, Arizona Revised Statutes and amendments thereto, by annexing the Indian School Road Right-of-Way from Citrus Road to Cotton Lane which is contiguous to the existing City limits of the City of Goodyear.

7.J.     (08-3988) Council adopted Ordinance 08-1150 extending and increasing the corporate limits of the City of Goodyear, Maricopa County, State of Arizona, pursuant to the provisions of Title 9, Chapter 4, Article 7, Arizona Revised Statutes and amendments thereto, by annexing the Thomas Road Right-of-Way from Cotton Lane to Loop 303 which is contiguous to the existing City limits of the City of Goodyear.

7.K.    (08-4022) Council authorized staff to enter into an amendment to Contract #CON-CX-0976-07 with Barton Malow Company for Construction Manager at Risk Construction Phase services for Phase II of the Goodyear Recreational Complex (Cincinnati Reds Development Complex) Guaranteed Maximum Price (GMP) 1 in an amount not to exceed $11,954,583.

7.L.     (08-3946) Council authorized the City Manager to execute a contract with Smart Use LLC for the proposed City-wide residential audit program.

8.A.    (08-3991)

1. Council conducted a Public Hearing to consider the submittal of two Community Development Block Grant applications and one HOME application to the Maricopa County Community Development Department for the purpose of fulfilling the projects outlined in the Consolidated Plan for 2009-2010 fiscal years.

2. Council adopted Resolution 08-1277 of the Mayor and Council of the City of Goodyear, Maricopa County, Arizona authorizing the submission of two applications for FY 2009-2010 Community Development Block Grant (CDBG) Program Funds and one application for the FY 2009-1010 Home Program Funds to the Maricopa County Community Development Department and authorizing the City Manager to execute all documents relating to said applications.

8.B.    (08-3997)

1. Council conducted a public hearing to discuss adoption of Resolution No. 08-1273 approving a request from RBF Consulting, on behalf of Goodyear 142, LLC, for a Major Amendment to the Goodyear General Plan to amend the planned land uses on approximately 142 acres located south of MC-85 and west of the Sarival Avenue alignment as shown on Exhibit 5 of the document entitled “Goodyear 142 Major General Plan Amendment”, dated October 30, 2008.

2. Council adopted Resolution No. 08-1273 approving a major amendment to the Goodyear General Plan 2003–2013 to amend the planned land uses for Goodyear 142 containing 142 acres located south of MC-85 and west of the Sarival Avenue Alignment from Low Density Residential to Medium High Density Residential (25 acres) and Light Industrial (117 acres), as shown on Exhibit 5 of the document entitled “Goodyear 142 Major General Plan Amendment” dated October 30, 2008; and providing an effective date.

8.C.    (08-3998)

          1.       Council conducted a public hearing to discuss adoption of Resolution No. 08-1274 approving a request from the City of Goodyear Community Development Department to amend the text of the General Plan to clarify the criteria and process used to determine what constitutes a Major General Plan Amendment and what constitutes a Minor General Plan Amendment.

          2.  Council adopted Resolution 08-1274 approving a major amendment to the Goodyear General Plan 2003-2013 to amend the text of the General Plan to clarify the criteria and process used to determine if a proposed change in land use is a major amendment or minor amendment to the general plan by deleting Section 2.3.6 of Chapter 2, Land Use Element, and replacing it with a new Section 2.3.6 as described herein; and providing for an effective date.

8.D.    (08-4002)

1. Council conducted a public hearing to discuss adoption of Resolution No. 08-1275 approving a request from Vanessa Hickman, Withey Morris, PLC., on behalf of DRM Farms, LLC, for a major amendment to the Goodyear General Plan to amend the planned land uses on approximately 246 acres generally located south of Southern Avenue, east of Perryville Road and northwest of MC-85 as shown on Exhibit L of the document entitled El Rio Crossing: A Major General Plan Amendment, dated September 9, 2008.

2.  Council adopted Resolution 08-1275 approving a major amendment to the Goodyear General Plan 2003–2013 to amend the planned land uses for El Rio Crossing containing  246 acres  generally located south of Southern Avenue, east of Perryville Road and northwest of MC-85 from the Rural Residential (226 acres) and Community Commercial (20 acres) land use designations to the High Density Residential (45 acres), Community Commercial (19 acres), Regional Commercial (114 acres), Light Industrial (44 acres), and right-of-way for the proposed Loop 303 (24 acres), as shown on Exhibit L of the document entitled “El Rio Crossing: a Major General Plan Amendment,” dated September 9, 2008; and providing for an effective date.

8.E.    (08-4006)

          1. Council conducted a public hearing to discuss adoption of a Resolution approving a request from Civica Development, represented by Ed Reichenberg, on behalf of Abel Partners, LLC, for a Major Amendment to the Goodyear General Plan to change the planned land use from Rural Residential to Light Industrial for 254 acres generally bounded by Camelback Road on the north, Citrus Road on the west and the Luke Air Force Base 65 DNL contour line on the east and south, as shown on Figure 4 of the document entitled “North City Commerce Park Major General Plan Amendment” dated June 4, 2008.

          2. Council postponed adoption of a Resolution until August 24, 2009, or until it can be considered concurrently with an application to rezone the property to an appropriate zoning district, whichever occurs first.

8.F.    (08-4007)

          1. Council conducted a public hearing to discuss adoption of Resolution 08-1276 approving a request from the City of Goodyear for a Major Amendment to the Goodyear General Plan to officially add 3,580 acres of land referred to as Southwest Goodyear to the City’s Municipal Planning Area and formally establish the planned land uses on this acreage as 1,870 acres of Open Space, 1,390 acres of Rural Residential and 320 acres of Low Density Residential, as shown on Exhibit “D” of the document entitled “Southwest Goodyear General Plan Amendment” dated September 9, 2008.

          2. Council adopted Resolution No. 08-1276 approving a major amendment to the Goodyear General Plan 2003-2013 to officially add 3,580 acres referred to as Southwest Goodyear to the City’s Municipal Planning Area, generally located between a point ½ mile north of Chandler Heights Road and Patterson Road and between 187th avenue and 203rd avenue, and formally establish the planned land uses on this acreage as Open Space (1,870 acres), Rural Residential (1,390 acres) and Low Density Residential (320 acres) as shown on Exhibit D of the document entitled “Southwest Goodyear General Plan Amendment” dated September 9, 2008; and providing for an effective date.

8.G.    (08-4011)

          1. Council conducted a public hearing to discuss adoption of a Resolution approving a request from Michael J. Curley of Earl, Curley & Lagarde, P.C., on behalf of Tuthill & Germann, LLC, for a Major Amendment to the Goodyear General Plan to facilitate future zoning and development of approximately 2,554 acres, expanding the City of Goodyear Municipal Planning area, and designating the land uses for the new area, for property generally located west of the 203rd Avenue alignment and south of the Pecos Road alignment in the Rainbow Valley area, as depicted on the attached “Current/Proposed General Plan”, dated received October 1, 2008;

          2. Council postponed adoption of a Resolution until the January 12, 2009 City Council meeting.

8.H.    (08-4023) Council approved Special Use zoning for a Fry’s Marketplace Large Retail User (LRU) with a drive-thru pharmacy and limited outdoor display of merchandise to be developed on 12 acres within the 23-acre Sarival Marketplace commercial center proposed at the northwest corner of Sarival Avenue and Yuma Road, subject to the amended stipulations.

8.I.     (08-4024) Council approved a site plan for a Fry’s Marketplace Large Retail User (LRU) with a drive-thru pharmacy to be developed on 12 acres within the 23-acre Sarival Marketplace commercial center proposed at the northwest corner of Sarival Avenue and Yuma Road, subject to the stipulations contained within the staff report.

8.J.     (08-4025) Council approved the request for a Use Permit to allow a fueling station as a convenience use on a 1.76-acre parcel in the Sarival Marketplace Commercial Center, generally located at the northwest corner of Sarival Avenue and Yuma Road, subject to the stipulations contained within the staff report.

8.K.    (08-4018) Council approved a use permit for two freeway pylon signs within the Airport Gateway at Goodyear Planned Area Development, generally located on the east side of Bullard Avenue, south of Interstate 10, subject to amended stipulations.

8.L.     (08-3974) Council approved Special Use zoning for the Vineyard Christian Fellowship West Valley Church use at 255 North Litchfield Road, subject to the recommended stipulations.
